Terms & Conditions

Welcome to Mursilex Delivery Services. These Terms & Conditions govern your access to and use of our website, mobile applications, and the parcel delivery, pickup, transportation, and related logistics services we provide within Morocco and, where applicable, via our international partners. Please read these Terms carefully. By using our services you agree to be bound by these Terms.

1. Definitions

  • Customer — the sender or recipient of a Shipment and any person or entity using Mursilex services.
  • Shipment — any parcel, package, document or item tendered to Mursilex for carriage, handling or delivery.
  • Declared Value — the value declared by the Customer for a Shipment for purposes of liability and/or insurance.

2. Scope of Services

Mursilex provides domestic parcel pickup, handling, transportation and delivery services. International carriage may be offered in partnership with third-party carriers. Service availability, transit times and specific terms for international shipments are subject to third-party carrier terms and applicable import/export and customs rules.

3. Eligibility & Accounts

To use certain features you may be required to register for an account. You must provide accurate, complete information and keep it up to date. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You agree to notify us immediately of any unauthorized use.

4. Booking, Pickup & Delivery

  • Booking: All bookings must include full and correct sender and recipient details (name, phone number, email and delivery address). Incorrect information may delay delivery and may incur additional charges.
  • Pickup: Pickup times are estimates; drivers will make reasonable efforts to collect within scheduled windows.
  • Delivery Attempts: We will make a reasonable number of delivery attempts. If delivery cannot be completed, the shipment may be held at a local facility or returned to sender according to our standard procedures.
  • Proof of Delivery: Proof of delivery may be recorded by signature, photo, or electronic confirmation. Receipt of a signature or photo is prima facie evidence that delivery was completed to the address provided.

5. Packing, Labelling & Customer Responsibilities

Customers are responsible for properly packing and labeling Shipments to withstand normal handling. Fragile, valuable or easily damaged items require appropriate packaging and should be declared. Mursilex may refuse to accept poorly packaged items at its discretion.

6. Prohibited & Restricted Items

You must not ship prohibited items. Examples of prohibited or restricted items include (but are not limited to):

  • Explosives, flammable liquids, toxic substances and other hazardous materials (unless agreed and documented in writing);
  • Illegal drugs and narcotics, stolen or counterfeit goods;
  • Cash, negotiable instruments, precious stones and high-value jewelry (unless specifically accepted and insured);
  • Live animals or perishable foodstuffs without prior written agreement;
  • Any item prohibited by applicable Moroccan or destination country law.

We reserve the right to open and inspect Shipments and to refuse carriage, and you will indemnify Mursilex for any loss arising from shipping prohibited items.

7. Insurance & Declared Value

Liability for loss or damage to a Shipment is limited to Mursilex’s liability under these Terms and applicable law. Customers may declare a value for a Shipment (Declared Value) and/or purchase additional insurance coverage where available. Declaring a value and/or purchasing insurance may increase the available compensation in the event of loss or damage. Failure to declare value may limit available recovery.

8. Limitation of Liability

Except where prohibited by law, Mursilex’s liability for any loss or damage (whether in contract, tort including negligence, or otherwise) is limited to the lesser of the Declared Value of the Shipment or the maximum amount permitted by applicable law. Mursilex is not liable for indirect, special, incidental or consequential losses, including loss of business, profits or goodwill. Where the law requires higher liability limits for particular Shipments, those legal limits will apply.

9. Claims & Complaints Procedure

If your Shipment is lost, damaged or delayed, you must follow the claims procedure below:

  • Immediate notification: Report visible damage upon delivery to the driver and note it on the delivery proof if possible.
  • Written claim: Submit a written claim to contact@mursilex.com within 7 days of delivery for visible damage and within 30 days for loss of Shipment. For concealed damage discovered after delivery, notify us as soon as reasonably possible and provide supporting evidence.
  • Required information: Claims must include booking/tracking number, sender and recipient details, description of loss/damage, images, proof of value (invoice/receipt) and proof of packaging where available.
  • Investigation & resolution: We will acknowledge receipt of your claim and investigate. Resolution time varies by case and may require cooperation with third-party carriers; we will keep you informed.

10. Payments, Fees & Taxes

  • Service fees, surcharges (e.g. fuel, peak period, remote area) and applicable taxes are charged to the Customer. Fees are payable at the time of booking unless a credit arrangement exists.
  • Cash on Delivery (COD) collections are processed in accordance with our COD policy; collected funds will be remitted to the sender per agreed timelines after reconciliation.
  • Customers are responsible for any customs duties, import taxes or other charges levied by destination countries for international Shipments.

11. Customs, Export & Import

For international Shipments, Customers must comply with all export, import and customs laws of Morocco and destination countries. You must provide accurate descriptions and values for goods. Mursilex and our partners may provide customs clearance services but are not customs authorities; you are responsible for duties, taxes and any penalties arising from incorrect declarations.

12. Force Majeure

We are not liable for delays or failures resulting from events beyond our reasonable control, including natural disasters, strikes, war, acts of government, pandemics, transportation disruptions, or other force majeure events. Where possible we will provide notice and take steps to minimize disruption.

13. Third-Party Carriers & Subcontracting

Mursilex may subcontract carriage or other services to authorized third-party carriers and service providers. When we do so, those parties’ terms and limitations may apply. We remain responsible for coordinating service but are not liable for third-party carrier actions beyond our control except where required by law.

14. Data Protection & Privacy

We process personal data in accordance with our Privacy Policy. By using our services you consent to the collection, use and disclosure of your personal information for purposes of providing, billing and improving our services, and where required by law or lawful requests from authorities.

15. Intellectual Property

All content on our website and applications including trademarks, logos, text, graphics and software is the property of Mursilex or its licensors and is protected by applicable intellectual property laws. You may not copy, reproduce or use our content without our express written permission.

16. Termination & Suspension

We may suspend or terminate access to services and accounts where there is a breach of these Terms, fraudulent activity, failure to pay outstanding fees, or behaviors that may expose Mursilex to liability or regulatory risk. Termination does not relieve you of obligations accrued prior to termination.

17. Amendments to Terms

We may update these Terms from time to time. Material changes will be posted on our website with an updated “Last updated” date and, where appropriate, notified to registered Customers. Continued use of services after changes constitutes acceptance of the updated Terms.

18. Governing Law & Dispute Resolution

These Terms are governed by the laws of the Kingdom of Morocco. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the Moroccan courts, unless the parties agree to an alternative dispute resolution mechanism in writing.
